These conditions govern use of South Carolina Criminal History. Accessing a page, reading its content, or submitting a search means the visitor accepts every term stated below. Anyone who does not agree must stop using the website.

NO FCRA USE. South Carolina Criminal History is privately owned and has no government affiliation. Neither the website nor its advertising partners provide services for credit decisions, employment screening, insurance underwriting, tenant evaluation, or another purpose regulated by the Fair Credit Reporting Act (FCRA). The website is a records-reference resource, not a private investigation firm or consumer reporting agency.

1. What This Website Is

This is a private reference site, independent of every government office. It neither stores official criminal records nor retrieves records, conducts official checks, or submits legal documents for a visitor.

Its content identifies South Carolina record custodians, including SLED Criminal Justice Information Services, the Department of Corrections, the South Carolina Sex Offender Registry, state courts, and agencies across 46 counties. Some pages also connect visitors to outside research tools. Public-body access is governed by laws such as the South Carolina Freedom of Information Act, S.C. Code Title 30, Chapter 4, and SLED criminal-history dissemination is governed by S.C. Code §23-3-115.

2. Rules for Using This Site

By using the website, a visitor agrees not to:

  • Use automated scrapers, bots, or similar collection tools against the pages
  • Violate a federal, South Carolina, or local law
  • Attempt unauthorized access to a system, account, or restricted function
  • Use information to stalk, threaten, or harass another person
  • Rely on website content for hiring, housing, lending, or insurance decisions
  • Disrupt service, slow the website, or interfere with another visitor's access

3. No Harassment, Stalking, or Discrimination

No website or linked-tool information may be used to intimidate, harass, stalk, threaten, or discriminate against a person. Misuse may violate criminal law. South Carolina registry information is especially sensitive: S.C. Code §23-3-510 permits added punishment when another crime is committed using disclosed South Carolina Sex Offender Registry information. Registry access supports lawful public-safety awareness, not vigilantism, blacklisting, or discrimination.

4. We Are Not a Consumer Reporting Agency

South Carolina Criminal History is not a consumer reporting agency under the FCRA and does not create credit reports, background checks, or any other consumer report. Its advertising partners likewise are not presented as services for applicant screening, rental review, insurance pricing, or credit evaluation. A visitor may not use data from the website or a linked tool to:

  • Set an insurance premium or evaluate creditworthiness
  • Make a hiring or termination decision
  • Screen a renter or housing applicant
  • Decide eligibility for a license, permit, or public program
  • Carry out any other activity regulated by the FCRA

A lawful regulated check must be obtained through an authorized official process or a screening company that complies with the FCRA.

5. No Legal Advice

Website content is not legal advice. General information about South Carolina records cannot determine how an expungement rule, conviction, warrant, or pending charge applies to one person's facts. Obtain advice from a lawyer licensed in South Carolina.

6. No Warranties

All content and functions are provided "as is." No warranty is made that:

  • A partner search result will be accurate or complete
  • Information will always be current, correct, and exhaustive
  • The website will operate without interruption
  • Pages will be free from errors, defects, or security weaknesses

South Carolina records can change when a charge is amended, dismissed, sealed, or expunged. Updates and reporting gaps are unavoidable. Content here is never an official statement from SLED, a court, a sheriff, or another government agency.

7. Third-Party Services and Links

Links lead to government agencies, court portals, county offices, legal resources, and commercial services. A destination is controlled by its owner. South Carolina Criminal History is not responsible for that site's availability, content, fees, data handling, or terms. Review the destination's rules before using it.

8. Intellectual Property

Text, graphics, logos, and code belong to South Carolina Criminal History or its content partners. They may not be copied, changed, distributed, or used to create derivative material without prior written permission.

9. Limits on Our Liability

To the greatest extent permitted by law, South Carolina Criminal History is not liable for damages arising from website use, including reliance on information obtained here or through a linked service.

10. Indemnification

A visitor agrees to indemnify and hold the website harmless from claims, demands, or legal proceedings caused by the visitor's use or breach of these terms, including related legal expenses.

11. Governing Law

South Carolina law governs these terms, including applicable provisions of the South Carolina Freedom of Information Act and S.C. Code §23-3-115 where public-record access or criminal-history dissemination is relevant. A dispute arising from website use must be brought in a court located in South Carolina.

13. Cutting Off Access

Access may be restricted or terminated at any time, with or without advance notice.

14. Severability

If a provision is found invalid or unenforceable, the remaining provisions continue in force. The affected term will be narrowed only as much as necessary to make it enforceable.
